Admittedly, the appeal is concluded by the view taken by this Court in Textile Machinery Corpn. Ltd. vs. CIT 1977 CTR (SC) 151 : (1977) 107 ITR 195 (SC) : TC25R.490 and CIT vs. Indian Aluminium Co. Ltd. (1977) 108 ITR 367 (SC) : TC25R.547. In accordance with that view, the appeal fails and is dismissed.
There is no order as to costs.
